Biniyam files for joint custody of oldest son Simon - 90 DAY FIANCE
Biniyam Shibre, the star of 90 Day Fiance, has filed for joint custody of his oldest son Simon from a previous marriage.
Biniyam married Bria, an American woman, in June of 2016, as previously reported. Bria became pregnant one month later, according to the couple. She planned to return to Ethiopia to give birth after attending her sister's wedding in the United States.
Bria's baby was revealed to have health difficulties, similar to what Ariela went through during her pregnancy. "During a routine scan, it was discovered that her newborn son had the unusual birth defect gastroschisis, which meant his intestines were developing outside of his body," we wrote about Biniyam's first marriage. "Doctors were adamant that Bria not fly back to Ethiopia following the diagnosis."
Biniyam "was given humanitarian parole and was able to go to Iowa in time for the birth of his son β which appears to have been in early February of 2017" because to the assistance of a local lawmaker in Iowa.
Bria and Biniyam married in the United States in July of 2017. He would eventually have to return to Ethiopia, and the couple would soon part ways for good. Their divorce was finalized in April of 2019, at least one month after Biniyam and Ariela met.
Biniyam admitted on the show that he hasn't seen his son Simon since their divorce. The prospective professional MMA fighter, on the other hand, is hopeful that the courts will change that.
On September 27, 2021, Biniyam filed a Petition to Modify Custody and Establish Parenting Time. Bria was granted full custody of Simon under the original custody agreement (the Decision), according to the complaint.

Bria, Biniyam's ex-wife, was served with his petition on October 6, and she sought a Writ of Injunction a week later. On the same day, the Writ of Injunction was issued.
The injunction specifies a number of conditions that Biniyam must follow until the custody dispute is resolved. The Writ forbids Biniyam from performing the following:
Attempting or enabling a third party to pick up the minor kid at any [redacted] School District property;
Scheduling, attending, or participating in a parent-teacher conference or otherwise conferring with any [redacted] School District employee, or allowing a third party to do so on his behalf WITHOUT THE RESPONDENT'S EXPRESS WRITTEN CONSENT;
Posting or allowing a third party to post information regarding the minor child's progress, performance, experience, or any other aspect of his schooling on social media;
Disclosing or discussing information concerning the minor child's progress, performance, experience, or any other aspect of his or her education on television media, including but not limited to the 90 Day Fiance The Other Way television series;
Harassing the Respondent or her husband, [redacted], interfering with the Respondent's or her husband's privacy or rights, [redacted], until further order of the said District Court in the premises.
On November 23, 2021, a Mediation Certificate of Attendance was filed. The matter is still ongoing, with a trial slated on October 26 and 27, this year.
Biniyam filed an Affidavit of Financial Status as part of the custody proceedings on February 4, 2022. Biniyam indicates in the Affidavit that he has less than $500 in assets and a monthly income of $0.
On the current season of 90 Day Fiance, his address appears to be the same apartment complex that Ariela's parents initially rented for the pair.
The Writ of Injunction prohibits Biniyam from discussing information about his son Simon's life, but I don't believe it limits Biniyam from discussing petitioning for custody on the show.
